Terms of Service

1. Acceptance of Terms

By accessing or using gamiant.com, bodesgalaxy.com, the Bode's Galaxy game, the Gamiant mobile applications, or any other service operated by Gamiant, LLC ("we", "us", the "Services"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Services.

2. Eligibility

You must be at least 13 years old to use the Services (or 16 if you reside in the European Economic Area, or the minimum age required by your jurisdiction, whichever is higher). By using the Services you represent that you meet these requirements and that you have the legal capacity to enter into this agreement.

3. Accounts

Some Services (including Bode's Galaxy when launched) require you to create an account. You are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us immediately at security@gamiant.com if you suspect unauthorized use.

You may not transfer, sell, or share your account with anyone else. We reserve the right to suspend or terminate accounts found in violation of these Terms.

4. Acceptable Use

You agree not to:

  • Cheat, exploit bugs, use automated tools (bots, scripts), or otherwise gain unfair advantage in any Gamiant game
  • Harass, threaten, impersonate, or abuse other players or our staff
  • Post unlawful, infringing, hateful, or sexually explicit content
  • Attempt to access other users' accounts or any non-public part of the Services
  • Reverse-engineer, decompile, or copy our software except where applicable law permits
  • Use the Services for any illegal purpose or in violation of applicable law
  • Interfere with the operation of the Services or other users' enjoyment of them

5. User Content

You retain ownership of content you create through the Services (player names, journal entries, fleet flags, in-game chat, etc.). By submitting content you grant Gamiant, LLC a worldwide, non-exclusive, royalty-free, transferable license to host, display, reproduce, modify, and make derivative works of that content solely as needed to provide and improve the Services.

You represent that you have the right to grant this license and that your content does not violate any third party's rights or applicable law.

6. Our Intellectual Property

The Services, including all websites, games, source code, art, music, brand marks ("Gamiant", "Bode's Galaxy", logos), and other materials, are owned by Gamiant, LLC or our licensors and are protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Services for non-commercial personal use. All rights not expressly granted are reserved.

7. Early Access and Beta Disclaimers

Bode's Galaxy and other Gamiant titles may be offered in early access, beta, or pre-release form. Features, content, game balance, and economies are subject to change. We may reset gameplay progress, wipe servers, modify in-game items, or remove features during this period. By participating you acknowledge and accept these risks.

8. Purchases, Subscriptions, and Refunds

If you purchase Bode's Galaxy or in-game items through a third-party storefront (Steam, Google Play, Apple App Store), the storefront processes your payment and refunds according to its own policies. Gamiant, LLC does not directly process payments and is not responsible for storefront billing decisions.

Virtual currency or in-game items have no real-world monetary value, are non-transferable, and may be revoked if obtained through prohibited means.

9. Service Availability

We do our best to keep the Services running, but we do not guarantee continuous, uninterrupted, or error-free operation. Multiplayer servers may be down for maintenance, updates, or unforeseen reasons. Gamiant, LLC reserves the right to modify, suspend, or discontinue any Service at any time, with or without notice.

10. Disclaimers

The Services are provided "as is" and "as available" without warranty of any kind, express or implied. To the maximum extent permitted by law, Gamiant, LLC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be secure, error-free, or meet your expectations.

11. Limitation of Liability

To the fullest extent permitted by law, Gamiant, LLC and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangibles, arising out of or in connection with your use of the Services. Our total cumulative liability shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $50.

12. Indemnification

You agree to indemnify and hold harmless Gamiant, LLC from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your User Content, or your misuse of the Services.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including if we reasonably believe you have violated these Terms. You may stop using the Services at any time. Sections 5 (User Content license), 6 (Intellectual Property), 10–12 (Disclaimers, Liability, Indemnification), and 14 (Governing Law) survive termination.

14. Governing Law and Disputes

These Terms are governed by the laws of [PLACEHOLDER: jurisdiction — e.g., the State of Delaware, USA], without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Services shall be resolved in the state or federal courts located in [PLACEHOLDER: jurisdiction], and you consent to personal jurisdiction in those courts. If you are a consumer in the European Union, nothing here limits any mandatory rights you have under your local law.

15. Changes to These Terms

We may update these Terms from time to time. We will revise the effective date above and, for material changes, post a notice on the gamiant.com homepage or notify account holders by email. Your continued use of the Services after a change takes effect means you accept the updated Terms.

16. Miscellaneous

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Gamiant, LLC concerning the Services. If any provision is found unenforceable, the remainder will continue in effect. Our failure to enforce any provision is not a waiver of our right to do so later.
