BODE'S GALAXY — Terms of Service

Scope & Acceptance

These Terms of Service ("Terms") govern your access to and use of Bode’s Galaxy — the game client, its multiplayer servers, the website at bodesgalaxy.com, and related services (collectively, the "Service"). The Service is operated by Gamiant, LLC. By installing, accessing, or playing the Service, you agree to these Terms. If you do not agree, do not use the Service.

These Terms supplement and are read alongside the Privacy Declaration and the studio-wide Gamiant Terms of Service. Where this document and the studio Terms conflict for matters specific to Bode’s Galaxy, this document controls.

Eligibility

You must be at least 13 years old (or 16 in the European Economic Area, or the minimum age required by your jurisdiction, whichever is higher) to play Bode’s Galaxy. By playing, you affirm that you meet these requirements and that you have the legal capacity to enter this agreement.

Your Account

Bode’s Galaxy requires an account. You are responsible for:

Keeping your credentials private and secure
All activity that occurs under your account
Notifying us promptly at security@gamiant.com if you suspect unauthorized access

You may not share, sell, transfer, or trade your account. We may suspend or terminate accounts in violation of these Terms.

License to Play

Subject to these Terms, Gamiant, LLC grants you a personal, non-exclusive, non-transferable, revocable license to install and use Bode’s Galaxy for non-commercial personal entertainment. All rights not expressly granted are reserved by Gamiant, LLC.

The Service, including its code, art, music, ship designs, world geometry, story, brand marks ("Bode’s Galaxy", the spiral mark, "Galactic Trade Federation", "Auditor Corps"), and all related content, is owned by Gamiant, LLC or its licensors and protected by intellectual property law.

Rules of Conduct

While operating in the Bode’s Galaxy frontier, you agree to abide by the following:

No cheating. You may not use bots, scripts, memory editors, packet manipulation, third-party automation, or any unfair advantage. The Auditor Corps will detect, and consequences follow swiftly.
No exploits. If you discover a bug or duplication exploit, report it to security@gamiant.com rather than abusing it. Knowingly abusing exploits may result in account suspension and confiscation of ill-gotten gains.
No harassment. Threats, hate speech, doxxing, persistent targeted abuse, sexual content involving minors, and content glorifying real-world violence are prohibited in player names, flags, chat, journals, and any other in-game expression.
No impersonation. Do not impersonate Gamiant staff, the Auditor Corps, or other captains.
No real-money trading (RMT). You may not sell, trade, or transfer accounts, credits, or in-game items for real-world value outside official storefronts.
No illegal activity. Do not use the Service to commit, facilitate, or solicit illegal acts.
No interference. Do not reverse-engineer, decompile, disassemble, or attempt to extract source code or assets from the Service, except where applicable law expressly permits.

Violations & Enforcement

We may at our sole discretion warn you, restore stolen items or credits to victims, suspend or permanently terminate your account, ban your hardware or IP, and pursue legal remedies for serious violations. You may appeal enforcement actions to appeals@gamiant.com; our decision after appeal is final.

User-Created Content

You retain ownership of original content you create within the Service (player display name, flag designs, journal entries, screenshots, in-game chat). By creating such content within the Service, you grant Gamiant, LLC a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, reproduce, modify, and create derivative works of that content as needed to operate, promote, and improve the Service.

You warrant that you have the right to grant this license and that your content does not infringe the rights of any third party.

Virtual Items & Currencies

In-game credits, ships, items, cosmetics, and other virtual goods (collectively "Virtual Items") are licensed, not sold. They have no real-world monetary value, cannot be exchanged for real-world currency, and are non-refundable except as required by law or storefront policy. Virtual Items may be modified, balanced, deprecated, or revoked at any time, including without limitation when obtained through prohibited means.

Purchases & Storefronts

Bode’s Galaxy is distributed and sold through third-party storefronts (currently Steam, Google Play, and the Apple App Store). Those storefronts process your payments and refunds under their own policies. Gamiant, LLC does not directly handle billing. For refund requests, please contact the storefront from which you purchased.

Beta, Early Access & Service Changes

Bode’s Galaxy may be offered in pre-release, beta, or early-access form. During such periods, and in subsequent live operation, we may at any time and without prior notice:

Add, remove, balance, or modify game systems, items, ships, ships' stats, and the economy
Reset gameplay progress or wipe servers if necessary
Modify or discontinue any feature of the Service
Take Server downtime for maintenance or updates

By participating, you accept that the Service is evolving and acknowledge these risks.

Service Availability

We strive to keep the multiplayer servers running, but we do not guarantee continuous, uninterrupted, or error-free operation. The Service may be unavailable due to maintenance, updates, infrastructure issues, force majeure, or other causes within or beyond our control.

Disclaimers

The Service is provided "as is" and "as available" without warranty of any kind, express or implied. To the maximum extent permitted by law, Gamiant, LLC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be secure, error-free, or meet your expectations.

Limitation of Liability

To the fullest extent permitted by law, Gamiant, LLC and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangibles, arising out of or in connection with your use of the Service. Our total cumulative liability for any claim arising from or related to the Service shall not exceed the greater of (a) the amount you paid for the Service in the 12 months preceding the claim, or (b) USD $50.

Indemnification

You agree to indemnify and hold harmless Gamiant, LLC from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your User Content, or your misuse of the Service.

Termination

We may suspend or terminate your access to the Service at any time, with or without notice, including for breach of these Terms. You may stop using the Service and delete your account at any time. The sections governing User Content, Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law survive termination.

Governing Law & Disputes

These Terms are governed by the laws of [PLACEHOLDER: jurisdiction — e.g., the State of Delaware, USA], without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in [PLACEHOLDER: jurisdiction], and you consent to personal jurisdiction in those courts. If you are a consumer in the European Union, nothing here limits any mandatory rights you have under your local law.

Changes to these Terms

We may update these Terms as the Service evolves. The effective date above will be revised. For material changes we will post a notice on bodesgalaxy.com, and where appropriate notify account holders by email or in-game. Your continued use of the Service after a change takes effect means you accept the revised Terms.

Miscellaneous

These Terms, together with the Privacy Declaration, constitute the entire agreement between you and Gamiant, LLC concerning Bode’s Galaxy. If any provision is found unenforceable, the remainder of the Terms will continue in effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.
